Debt Collection Goes Digital
The CFPB recently finalized a rule that allows debt collectors to contact debtors using email, text or social media. The new rule will take effect in late 2021. Since the FDCPA was enacted in 1977, there has been little guidance about contacting debtors digitally. Consumers are given the option to unsubscribe from receiving emails or text messages that debt collectors send.
The rule restates the FDCPA's prohibition against debt collectors repeatedly contacting debtors by phone, but now clarifies that calls that go directly to voicemail are also included in the definition of what constitutes contact.
